Refurbished Bike Sale Terms of Service

Effective Date: 17 April 2025

Please read these terms carefully before confirming your reservation.

1. About Bike Worcester and Our Bikes:

  • Bike Worcester is a community project primarily run by dedicated volunteers. Our aim is to promote cycling, reduce waste by recycling unwanted bicycles, and provide affordable, functional transport options to the community.

  • The bicycles we offer for sale are used and have been refurbished by our volunteer team. They are not new bicycles.

  • Funds generated from bike sales are reinvested directly back into the Bike Worcester project to cover operational costs (parts, tools, workshop space) and support our community objectives. We are not a commercial bike shop operating for profit.

2. Condition of Bicycles & Our Process:

  • Each bicycle undergoes a refurbishment process by our volunteers, which includes safety checks and essential repairs to ensure it is in a roadworthy condition at the point of handover.

  • Our inspection process is robust, aiming to identify and rectify significant mechanical issues. However, as these are used bicycles, they may exhibit signs of wear and tear, cosmetic imperfections (scratches, scuffs, minor rust), or possess components that, while functional, are not new.

  • Residual Risk: Despite our best efforts, used components can have a shorter lifespan than new ones, or underlying issues may not be immediately apparent. We aim to be transparent about any significant limitations we are aware of, but buyers should understand the inherent nature of purchasing a second-hand item.

3. "Sold As Seen" & Post-Sale Issues:

  • All refurbished bicycles are sold on a "Sold As Seen" basis. This means Bike Worcester does not offer a formal warranty (e.g., a 1-month guarantee) on purchased bicycles.

  • By purchasing a bike, you acknowledge its used, refurbished nature and accept it in its current condition at the point of sale.

  • Our Commitment: While we don't offer a warranty, we are committed to our community aims. If you experience a significant functional problem directly related to the refurbishment work undertaken by Bike Worcester within a short period after purchase (e.g., 14 days), please contact us directly first. We encourage open communication. We will review the issue on a case-by-case basis and, at our sole discretion, assess if a reasonable resolution (such as advice, minor adjustment, or suggesting repair options) can be offered. This is undertaken in the spirit of goodwill by our volunteer team and is not a guarantee of free repair, replacement, or refund.

  • We cannot be responsible for issues arising from:

    • Normal wear and tear.

    • Damage occurring after collection.

    • Improper use, accidents, neglect, or lack of routine maintenance (e.g., tyre inflation, chain lubrication).

    • Failures of components that were functional at the time of sale but have since worn out due to the bike's age/prior use.

    • Modifications made by the owner after purchase.

4. Reservation and Acceptance of Terms:

  • Bikes may be reserved via our agreed process (e.g., online form, email). You will receive a confirmation email containing a link.

  • Crucially, by clicking the confirmation link in your reservation email, you explicitly acknowledge that you have read, understood, and agree to be bound by these Terms of Service.

  • If you do not agree with these terms, please do not click the confirmation link. Contact Bike Worcester immediately to discuss your concerns or cancel your reservation. Proceeding with the collection implies acceptance of these terms.

5. Limitation of Liability:

  • Bike Worcester, including its volunteers and organisers, shall not be liable for any loss, damage, injury, or cost arising from the use (or misuse) of the bicycle after it has been collected by the purchaser, except where liability cannot be excluded by law (e.g., personal injury caused directly by our negligence during refurbishment, which we strive to prevent through our checks).

  • Ongoing maintenance and safe usage of the bicycle are the sole responsibility of the owner.

6. Dispute Resolution:

  • We value our relationship with the community. Should any issues arise, we request that you contact Bike Worcester directly in the first instance to allow us the opportunity to understand and, where appropriate and feasible within our volunteer capacity, address your concerns reasonably.

7. Governing Law:

  • These Terms of Service shall be governed by and construed in accordance with the laws of England and Wales.

8. Changes to Terms:

  • Bike Worcester reserves the right to amend these Terms of Service at any time. The terms applicable will be those in effect at the time you confirm your reservation by clicking the link.
